AHMEDABAD: The division Bench
of the Gujarat High Court has ruled that the Gujarat
Self-Financed (GSF) Medical and Para-medical Association
cannot hold a separate common entrance test (CET) and have
to follow a single-window system for admissions.
The division Bench comprising
acting chief justice YR Meena and justice AS Dave, upheld
the judgement given by single judge Akil Kureshi on
September 8. The division Bench was acting on a petition
filed by GSF Association challenging the single judge's
order. The Association had prayed to be allowed to conduct
their own CET and to admit students on the basis of this
test.
The court observed that the
GSF Association suffers from erosion of credentials on
account of its past record of conducting unfair and
non-transparent CET. The Association had already exercised
its fundamental right of choosing that they will give
admission as per Gujarat Common Entrance Test (GujCET).
The court further observed
that 18 of 28 institutions under the Association have
already accepted GujCET. The remaining 10 colleges, being in
minority, cannot exercise their right in this
perspective.Last week, the Supreme Court had granted interim
relief to the Association and allowed it to conduct CET.
However, this would be subject
to the final outcome of the petition filed in SC, wherein
the hearing is scheduled on September 29.
