AHMEDABAD: The Gujarat High
Court has upheld the decision of state government on
admitting students to professional grant-inaid colleges by
considering the marks of HSC as well as the Gujarat Common
Entrance Test (GujCET).
The court acted on a petition
filed by a group of 10 students who had appeared for their
higher secondary school examination under the Central Board
of Secondary Education (CBSE).
The students had challenged
the decision of state government to give admission to
professional courses cons i d e r i n g merit based on HSC
and Guj CET marks in the ratio of 60:40.
It was argued that court
should direct state to admit students only on the basis of
Guj CET conducted by the state, since the state had two
education boards - the Gujarat board and the central board.
It was also submitted that
when the state already held the CET, there cannot be two
different examinations to determine merit for professional
courses.
However, the court refused to
interfere in policy decisions and held that, "It was a
policy matter and experts had taken a decision looking at
the need of local area".
The petition was dismissed.
Appearing for the state, advocate general Kamal Trivedi
argued that the state had already made it clear in March
last year that the weightage that both HSC and GujCET marks
carry would be given.
The students were made aware
of the decision before the test and after the results were
announced, the petition could not be maintained.
Arun Oza, appearing for the
Gujarat Higher Secondary and Secondary Education Board said
that the board was asked to conduct the examination and
thereafter the rules were framed in consultation with
educationists which included principals of the CBSE schools.
He also submitted that the announcement was made well in
